A BILL to amend article five, chapter nine of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section eleven-d,
relating to requiring itemized statements of services rendered
to medicaid recipients; directing the department of health and
human resources to prescribe forms for itemized statements;
and providing for verification of the accuracy of same or
investigation by the department of health and human resources
into discrepancies.
Be it enacted by the Legislature of West Virginia:
That article five, chapter nine of the code of West Virginia,
one thousand nine hundred thirty-one, as amended, be amended by
adding thereto a new section, designated section eleven-d, to read
as follows:
ARTICLE 5. MISCELLANEOUS PROVISIONS.
§9-5-11d. Itemized statements of medicaid services rendered.
All recipients of medical services under the medicaid program
shall be furnished an itemized statement of the services or
assistance they receive from each provider of medical services or
medical assistance and any other services or assistance authorized
by this chapter. If the itemized statement is accurate as to the
assistance or service provided, the recipient or the guardian,
committee or attorney in fact for the recipient shall sign the
itemized statement verifying the receipt of the assistance or
services. If the itemized statement is not accurate, or if the
recipient, guardian, committee or attorney in fact for the
recipient disagrees with any service or assistance described on the
itemized statement, the department of health and human resources
shall be notified immediately. The department of health and human
resources shall prescribe the form of the itemized statement and
investigate any discrepancy brought to its attention by or on
behalf of a medicaid assistance recipient.
NOTE: The purpose of this bill is to require providers of
medicaid services to send the recipient an itemized statement of
services rendered. If the statement is accurate, the recipient
verifies it by signing. If the statement is incorrect, the
discrepancy is to be reported to DHHR, which shall investigate.
